2.1 Acceptance of Terms

By visiting our café, ordering products, using our facilities, or purchasing a Day Pass, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2.2 Age Requirements

Our services are available to individuals of all ages. However, minors under the age of 18 must be accompanied by a parent or legal guardian when visiting our premises. Persons under 18 may not purchase a Day Pass without parental consent.

2.3 Right to Refuse Service

Krème Kultura reserves the right to refuse service to anyone for any lawful reason, including but not limited to disruptive behavior, violation of café policies, intoxication, or failure to comply with health and safety regulations.

2.4 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or display at our premises. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

3. Products and Services

3.1 Menu and Availability

All menu items, including coffee, food, and beverages, are subject to availability. We reserve the right to modify our menu, discontinue items, or substitute ingredients without prior notice due to seasonality, supply chain considerations, or quality standards. Single-origin coffee offerings rotate seasonally and may not always be available.

3.2 Pricing

All prices are listed in Indian Rupees (INR) and are subject to change without notice. Prices displayed on our menu boards, website, or promotional materials are accurate at the time of publication but may be updated. Applicable taxes will be added to all purchases as required by law.

3.3 Quality and Preparation

We take pride in our craft and prepare all items using premium ingredients and professional equipment, including our CIME Saturno espresso machine. While we strive for consistency, natural variations in coffee beans, handcrafted preparation, and artisanal techniques may result in slight differences between servings.

3.4 Food Allergies and Dietary Restrictions

Our kitchen handles common allergens including dairy, eggs, nuts, gluten, and soy. While we take precautions, we cannot guarantee that any item is completely free from allergens due to shared equipment and preparation spaces. Customers with severe allergies should inform our staff before ordering. Krème Kultura is not liable for allergic reactions resulting from consumption of our products.

3.5 Third Wave Coffee Standards

Our coffee is prepared according to third wave coffee principles using 100% Arabica beans. Brewing methods including espresso, pour over, V60, Aeropress, and French press are performed by trained baristas. Extraction parameters are optimized for each origin and may vary based on bean characteristics.

4. Day Pass Program

4.1 Day Pass Purchase and Validity

Day Pass must be purchased in advance or upon arrival, subject to availability. Each Day Pass is valid for one calendar day from opening to closing time on the date of purchase. Day Passes are non-transferable and valid only for the purchaser whose name appears on the pass.

4.2 Day Pass Inclusions

Day Pass includes: full-day access to café seating, unlimited high-speed Wi-Fi, access to power outlets, and complimentary select food and beverage items as specified at time of purchase. Specific inclusions may vary by Day Pass tier and are subject to menu availability. Premium menu items may not be included and will be specified at purchase.

4.3 Day Pass Terms of Use

Day Pass holders must comply with all café policies including respectful conduct, reasonable noise levels, and sharing of space during busy periods. Krème Kultura reserves the right to request Day Pass holders to relocate within the café or share tables during peak hours to accommodate other customers. Day Pass does not guarantee a specific seat or table.

4.4 Day Pass Cancellation and Refunds

Day Pass purchases are final and non-refundable. In the event of café closure due to unforeseen circumstances, emergency, or force majeure, we will offer a credit toward a future Day Pass or provide a refund at our discretion. Unused Day Passes cannot be rescheduled or exchanged.

4.5 Day Pass Suspension or Termination

Krème Kultura reserves the right to suspend or terminate Day Pass access for violation of café policies, disruptive behavior, misuse of facilities, or any conduct that negatively impacts other customers or staff. No refund will be provided in case of suspension or termination for policy violations.

5. Wi-Fi and Internet Access

5.1 Acceptable Use

Wi-Fi access is provided for lawful purposes only. Users must not engage in illegal activities, access inappropriate content, download or distribute copyrighted material without authorization, attempt to breach network security, or consume excessive bandwidth that degrades service for others.

5.2 No Guarantee of Service

While we strive to maintain reliable internet connectivity, Krème Kultura does not guarantee uninterrupted or error-free Wi-Fi service. We are not responsible for any loss of data, work, or productivity resulting from internet outages, slow speeds, or connectivity issues.

5.3 Security and Privacy

Our Wi-Fi network is provided on an unsecured basis. Users are responsible for implementing their own security measures including VPNs, firewalls, and encryption. Krème Kultura is not responsible for data breaches, unauthorized access, or privacy violations occurring over our network.

5.4 Monitoring and Compliance

We reserve the right to monitor network usage for security purposes and to ensure compliance with acceptable use policies. Users who violate these policies may have their access terminated immediately without notice or refund.

6. Conduct and Café Policies

6.1 Respectful Behavior

Customers must treat staff, other patrons, and café property with respect. Harassment, discrimination, abusive language, threatening behavior, or any conduct that creates a hostile environment will not be tolerated and may result in immediate removal from premises.

6.2 Workspace Etiquette

Customers using our space for work or study must maintain reasonable noise levels, take phone calls in designated areas or outside, and be mindful of shared space during busy periods. Monopolizing tables during peak hours or refusing to share space may result in being asked to vacate.

6.3 Outside Food and Beverages

Outside food and beverages are not permitted inside Krème Kultura except for medical or dietary necessity with prior approval from management. We reserve the right to ask customers to dispose of outside items.

6.4 Smoking and Substance Use

Krème Kultura is a smoke-free establishment. Smoking, vaping, and use of tobacco products are prohibited inside the café and within 10 feet of entrances. Consumption or possession of illegal substances is strictly prohibited and will result in immediate removal and notification of authorities.

6.5 Children and Supervision

Parents and guardians are responsible for supervising children at all times. Children must not be left unattended, run inside the café, or disturb other customers. We reserve the right to ask parents to manage disruptive behavior.

6.6 Photography and Recording

Personal photography of food, beverages, and café ambiance for non-commercial use is permitted. Commercial photography, videography, or content creation requires prior written permission from management. Customers must not photograph or record other patrons or staff without consent.

7. Equipment and Facilities

7.1 CIME Saturno and Equipment

The CIME Saturno espresso machine and all café equipment are operated exclusively by trained Krème Kultura staff. Customers may not touch, operate, or interfere with any café equipment. Unauthorized use or tampering may result in liability for damages.

7.2 Seating and Furniture

Café furniture and seating are provided for customer use during business hours. Customers must not move furniture without staff permission, damage property, or misuse facilities. Any damage caused by customer negligence or misuse will be charged to the responsible party.

7.3 Power Outlets and Charging

Power outlets are provided for customer convenience. Krème Kultura is not responsible for damage to electronic devices, power surges, or electrical issues. Customers use power outlets at their own risk.

7.4 Restroom Facilities

Restroom facilities are available for paying customers and Day Pass holders. Customers must maintain cleanliness and report any issues to staff immediately. Vandalism or misuse of facilities may result in removal from premises and potential legal action.

8. Payment and Transactions

8.1 Accepted Payment Methods

We accept cash, credit cards, debit cards, UPI, and other digital payment methods as displayed at point of sale. All payments must be made at time of order unless otherwise arranged for Day Pass or special services.

8.2 Payment Processing

Payment processing is handled through secure third-party payment gateways. Krème Kultura does not store complete credit card information. By providing payment information, you authorize us to charge the stated amount for your purchase.

8.3 Transaction Disputes

Any disputes regarding charges must be reported within 48 hours of transaction. We will investigate all legitimate claims and work toward resolution. After 48 hours, we may not be able to address payment disputes.

8.4 Tips and Gratuities

Tips are appreciated but not mandatory. Any gratuities provided are distributed to staff according to our internal policies. Tips are non-refundable once processed.

9. Refunds and Returns

9.1 Food and Beverage Returns

Due to health and safety regulations, we cannot accept returns of food or beverages once served. If you are unsatisfied with your order, please notify staff immediately, and we will make reasonable efforts to remedy the situation through replacement or credit toward future purchase.

9.2 Quality Guarantee

We stand behind the quality of our products. If your order does not meet our standards due to preparation error, defect, or quality issue, we will remake your order or provide a refund at our discretion. Claims must be made before consuming the majority of the item.

9.3 Day Pass Refunds

As stated in Section 4.4, Day Pass purchases are final and non-refundable except in cases of café closure or extraordinary circumstances at management's discretion.

9.4 Refund Processing

Approved refunds will be processed to the original payment method within 7-10 business days. Refund timing depends on your financial institution's processing schedule.

10. Health and Safety

10.1 Food Safety Standards

Krème Kultura complies with all applicable food safety regulations and maintains proper food handling, storage, and preparation procedures. Our staff is trained in food safety protocols and hygiene standards.

10.2 Cleanliness and Sanitation

We maintain high standards of cleanliness throughout our café. Regular cleaning and sanitation of surfaces, equipment, and facilities are performed according to health department guidelines.

10.3 Customer Health Responsibility

Customers who are ill or experiencing symptoms of contagious illness should not visit our café. We reserve the right to ask customers displaying obvious illness symptoms to leave the premises for the safety of others.

10.4 Emergency Procedures

In case of emergency, customers must follow staff instructions and evacuation procedures. Emergency exits are clearly marked. Customers must not block exits or emergency equipment.

10.5 First Aid

Basic first aid supplies are available on premises. In case of serious injury or medical emergency, emergency services will be contacted immediately. Krème Kultura is not liable for medical expenses resulting from accidents or injuries on premises except where caused by our negligence.

11. Intellectual Property

11.1 Trademarks and Branding

Krème Kultura, our logo, tagline 'Coffee Rituals | Curated Indulgence', and all related branding elements are the intellectual property of Krème Kultura. Unauthorized use, reproduction, or imitation of our branding is strictly prohibited.

11.2 Recipes and Methods

All recipes, preparation methods, menu items, and proprietary techniques are confidential and proprietary to Krème Kultura. Customers may not replicate, reproduce, or commercialize our products or methods.

11.3 Website and Digital Content

All content on our website, social media, and digital platforms including text, images, graphics, logos, and design elements are protected by copyright and intellectual property laws. Unauthorized reproduction or commercial use is prohibited.

11.4 Customer Content

By sharing photos, reviews, or content featuring Krème Kultura on social media or public platforms, you grant us a non-exclusive, royalty-free license to use, share, and feature your content in our marketing materials with appropriate credit.

12. Limitation of Liability

12.1 Personal Property

Krème Kultura is not responsible for lost, stolen, or damaged personal property including laptops, phones, bags, or other items brought onto premises. Customers are responsible for securing their belongings at all times. We recommend not leaving valuables unattended.

12.2 Personal Injury

While we maintain safe premises, Krème Kultura is not liable for injuries resulting from customer negligence, failure to observe warnings, or misuse of facilities. We are only liable for injuries directly caused by our negligence or failure to maintain safe conditions.

12.3 Indirect Damages

Krème Kultura shall not be liable for any indirect, incidental, consequential, or punitive damages including loss of profits, data, work product, or business opportunities arising from use of our services or premises.

12.4 Maximum Liability

In any event, Krème Kultura's total liability for any claims arising from your visit or use of our services shall not exceed the amount you paid for products or services on the date the claim arose.

12.5 Allergic Reactions

As stated in Section 3.4, customers with allergies use our services at their own risk. While we disclose common allergens, we cannot guarantee allergen-free products. Krème Kultura is not liable for allergic reactions except in cases of gross negligence or intentional misrepresentation.
